[Article 1 [Purpose)]


These Terms and Conditions shall be governed by and construed in accordance with the terms and conditions of the Cyber ​​Mall and the User’s right to use Internet related services (hereinafter referred to as “Services”) provided by Power Audio Cyber ​​Mall (hereinafter referred to as “Mall”) operated by Power Audio Company · It is for the purpose of stipulating obligations and responsibilities. ※ “We comply with these terms for electronic transactions using PC communications, etc., unless they are against its nature”


[Article 2 (Definition)]


① “Mall” is a hypothetical business place set up by Power Audio Company to deal with goods or services by using information and communication facilities such as computers to provide goods or services to users. In addition, Also used as a meaning.

② “User” means a member or non-member who accesses the Mall and receives the services provided by the Mall in accordance with these Terms and Conditions.

③ The term “member” means a person who provides personal information to the “Mall” and who has registered as a member, who is continuously provided with the information of “Mall” and who can continue to use the services provided by the Mall.

④ Non-member “means a person who does not join the membership but uses the services provided by the Mall.


[Article 3 (Specification and Revision of Terms)]


① The “Mall” is the initial service screen (front side) of the cyber mall so that the user can know the details of this agreement, the location of the office, the name of the representative, the business registration number and the contact (telephone, fax, e-mail address, ).

② The “Mall” may amend these Terms and Conditions to the extent that it does not violate the relevant laws such as the Act on Regulation of Terms, Electronic Commerce Act, Electronic Signature Act, Act on Promotion of Utilization of Information and Communication Network, .

③ When the “Mall” is amended, the applicable date and reasons for amendment shall be specified and announced on the initial screen of the mall together with the current terms from 7 days before the application date to the day before the application date.

④ If the “Mall” amends the terms, the amended terms will apply only to the contracts that are concluded after the effective date of the amendment. However, if the user who has already entered into the agreement transmits the intention to receive the amendment clause to the “Mall” within the notice period of the amendment clause under Paragraph 3 and receives the agreement of “Mall”, the amendment clause shall apply It’s possible.

⑤ The matters not specified in these Terms and the interpretation of these Terms and Conditions shall be governed by the Electronic Commerce Consumer Protection Directive and relevant laws and ordinances established by the Government.


[Article 4 (Provision and Change of Service)]


① “Mall” performs the following tasks.

  1. Provide information on goods or services and conclude purchase contracts
  2. Delivery of the goods or services for which the purchase contract is concluded
  3. Other duties designated by “mall”

② The “Mall” may change the contents of goods or services to be provided by a contract to be concluded in the event of the sale of goods or the change of technical specifications.

In this case, specify the content and date of the changed goods and services, and announce the contents of the current goods and services from the 7th day before the date of the delivery.

③ The “Mall” will compensate the user for the damage caused by the change of the contents of the service contracted with the user for reasons such as the change of the goods or the technical specification.

However, this does not apply if there is no intention or negligence in the “Mall”.


[Article 5 (Termination of Service)]


① The “Mall” may temporarily suspend the provision of services in the event of maintenance, replacement or breakdown of information and communication facilities such as computers, or loss of communication.

② In case of discontinuance of service under Paragraph 1, “Mall” will notify the user by the method set out in Article 8.

③ “Mall” shall be compensated for damages incurred by the user or a third party due to temporary interruption of service due to the reason stated in Paragraph ①. However, this shall not apply if there is no intention or negligence in the “Mall”.


Article 6 (Membership)


① The user submits the member information according to the registration form set forth by the “Mall”, and signs the agreement to agree to the terms and conditions of membership.

② The “mall” shall register as a member of the users who apply to join as a member,

  1. If the applicant has lost his / her previous membership pursuant to Paragraph 3 of Article 7 of this Agreement, he / she shall be the person who has passed 3 years after the loss of membership under Article 7 (3) Is obtained.
  2. If there is false information, missing information,
  3. If it is judged that the registration of other members is significantly impeded by the technology of “mall”

③ The time of establishment of membership contract is when the approval of “Mall” reaches the member.

④ If there is any change in the registration details pursuant to Article 15 (1), the member must inform the mall about the change immediately by email or other means.


Article 7 (withdrawal of membership and loss of qualification)


① A member may request withdrawal at any time from the “Mall”, and the “Mall” immediately handles withdrawal from membership.

② If a member falls under any of the following conditions, the “Mall” may limit and suspend membership.

  1. If you registered false information at the time of application
  2. If you do not pay on the due date for the purchase of goods or services purchased through the use of the Mall, or any other liability that the member pays for the use of the Mall.
  3. Threatening the electronic transaction order, such as interfering with the use of another person’s “mall” or stealing the information
  4. When using the “mall” to prohibit the laws and regulations, or to engage in acts contrary to public order and morals.

③ “Mall” may lose membership if the same act is repeated more than once after the “mall” restricts or stops membership, or if the reason is not corrected within 30 days.

④ If the “Mall” loses the membership, the membership registration will be canceled. In this case, we will notify the member and give them an opportunity to call before the expiration date.


Article 8 (Notice to Members)


① If the “mall” notifies the member, the member can make the e-mail address submitted to the mall.

② “Mall” can be replaced with individual notice by posting on the “Mall” bulletin board for more than one week in case of notice to many unspecified members.


Article 9 (Application for Purchase)


The “Mall” user applies for the purchase on the “Mall” by the following method.

  1. Enter your name, address, and phone number
  2. Selection of goods or services
  3. Choice of payment method
  4. Indication of acceptance of these terms


Article 10 (Establishment of Contract)


① The “Mall” agrees to the purchase application like Article 9 unless it falls under the following subparagraphs.

  1. If there is false information, omissions,
  2. If a minor purchases goods and services prohibited by the Juvenile Protection Act, such as tobacco and alcohol
  3. When it is judged that the acceptance of the other purchase application is considerably hindering the “mall” technology. ② The consent of the “mall” is considered to be established when the user reaches the user in the form of acknowledgment notice of Article 12 (1).


Article 11 (Method of Payment)


The payment method for goods or services purchased at “Mall” can be one of the following.

  1. Account Transfer
  2. Credit card payment
  3. Online deposit


  1. Payment by electronic money
  2. Payment upon payment


Article 12 (Notice of receipt of confirmation, change of purchase application and cancellation)


① The “Mall” will notify the user of the receipt when the user has a purchase application.

② The user who has received the acknowledgment of receipt may request the change or cancellation of the purchase application immediately after receiving the acknowledgment of receipt if there is any inconsistency in the intention to do so.

③ “Mall” will be processed according to the request without delay when there is a change request or cancellation request of the user before shipment.


Article 13 (Shipping)


The “Mall” specifies the shipping method, shipping cost for each method, and shipping time for each item purchased by the user. If the mall exceeds the contracted delivery time due to the intention or negligence of the mall, you will be liable for the damage caused by the user.


Article 14 (Refund, Return and Exchange)


① “Mall” means that if the goods or services to which the user has applied for purchase are unable to provide delivery of goods or services for reasons such as out of stock, he shall immediately notify the user of such reasons without prior notice and receive the goods or services If not, within 3 days from the date of receipt of payment, otherwise, within 3 days from the date of occurrence of the cause,

② In the case of the following items, “Mall” will promptly return, return and exchange goods within the next business day after the goods are returned even if they are shipped. However, the request period is within 20 days from the date of shipment.

  1. If the delivered goods are different from the order contents or the information provided by the “Mall”
  2. The goods shipped are damaged, damaged or contaminated. 3. Goods are delivered later than the shipment indicated in the advertisement.
  3. If a subscription has been made by the user without showing the matters to be displayed in the advertisement pursuant to Article 18 of the Act on Visit Sales, Etc.

Article 15 (Protection of Personal Information)


① “Mall” collects the minimum information necessary for the fulfillment of purchase contract when collecting information of users. The following items are mandatory and others are optional.

  2. Resident registration number (for members)
  3. Address
  4. Phone number
  5. Hope ID (for members)
  6. Password (for members)

② When the “mall” collects personal information that can identify the user, he / she must obtain the user’s consent. ③ Personal information provided can not be used for purposes other than without the consent of the user or provided to a third party, and all responsibility for this is “mall”. However, with the exception of the following cases.

  1. In the case of delivery, the shipper shall be informed of the minimum user’s information (name, address, telephone number) required for delivery.
  2. Providing specific individuals in an unidentifiable form for statistical writing, academic research or market research.

④ If the “mall” requires the consent of the user pursuant to Paragraphs 2 and 3, the identity (affiliation, name, telephone number and other contact) of the person in charge of personal information management, (The contents of information to be provided, the purpose of providing, and the information to be provided) prescribed in Article 16 (3) of the Act on Promotion of Utilization of Information and Communication Network, etc., and the User may withdraw this consent at any time You can.

⑤ The user may request the reading and correction of his / her personal information of the Mall at any time, and the mall is obliged to take necessary measures without delay. If the user requests correction of the error, “Mall” will not use the personal information until correcting the error.

⑥ “Mall” shall limit the number of administrators for the protection of personal information and shall take all responsibility for the loss of the user due to loss, theft, leakage, alteration of user’s personal information including credit card, bank account etc. .

⑦ The third person who receives personal information from the “Mall” will destroy the personal information without delay when it has achieved the purpose of collecting or receiving the personal information.


Article 16 (Obligation of the Mall)


① “The mall shall not do any act contrary to the laws and regulations, or the contrary to public order and sincerity, and shall do its best to provide goods and services continuously and reliably as stipulated in these Terms and Conditions.

② “Mall” must have a security system to protect user’s personal information (including credit information) so that users can use Internet service safely.

③ “Mall” shall be liable to compensate for damages caused by the user by doing unlawful display and advertisement prescribed in Article 3 of the Act on Fairness of Display and Advertisement of Goods and Services.

④ “Mall” does not send commercial e-mail for commercial purposes that users do not want.


Article 17 (Obligations for Member’s ID and Password)


① The member is responsible for the management of the ID and password except in the case of Article 15.

② Members shall not allow their ID and password to be used by a third party.

③ When a member recognizes that his / her ID and password are stolen or used by a third party, he / she shall notify the mall immediately and if there is guidance of “mall”, he / she should follow it.


Article 18 (Obligations of User)


The user should not conduct the following.

  1. Registration of false information when applying or changing
  2. Changes to information posted on the “Mall”
  3. Sending or posting information (such as a computer program) other than information set by the Mall.
  4. Infringement of intellectual property rights such as copyrights of “Mall” and other third parties
  5. Acts that damage or impair the “Mall” or other third parties’ honor.
  6. Obscene or violent messages, images, voices or other public information to the public to disclose information that is in conflict with the law


Article 19 (Relationship between a Linked Mall and a Linked Mall)


① When the upper “mall” and the lower “mall” are connected by a hyperlink (for example, the object of a hyperlink includes characters, pictures and moving images), the former is referred to as a connection “mall” The connection is called “mall” (website).

② The connection “mall” shall mean the guarantee of the transaction if the connection “mall” indicates in the site of the connection “mall” that the mall does not bear the guarantee responsibility for the transaction with the user by the goods and services provided independently. Article 20 (Restrictions on Use and Restriction of Copyright)


① Copyrights and other intellectual property rights for works created by “Mall” belong to “Mall”.

② Users shall not use the information obtained by using “mall” for commercial purposes or for use by third parties by copying, transmitting, publishing, distributing, broadcasting or other means without prior consent of “mall”.


Article 21 (Settlement of Disputes)


① The “Mall” will install and operate the damage compensation processing facility to reflect the legitimate opinions and complaints posed by the user and compensate the damage.

② The “Mall” will deal with complaints and comments submitted by the users with priority. However, if prompt processing is difficult, we will promptly notify the user of the reason and the processing schedule.

③ Disputes arising between the “Mall” and users may be subject to the arbitration of the Electronic Transaction Dispute Arbitration Committee established under Article 28 of the Electronic Commerce Basic Act and Article 15 of the Enforcement Decree.


Article 22 (Jurisdiction and Governing Law)


① The lawsuits related to the electronic transaction disputes between the “Mall” and the users shall be filed with the competent court under the Civil Procedure Act.

② The laws of Korea apply to electronic transactions filed between the “Mall” and users.
